Terms and Conditions

CONTRACT

These Terms and Conditions govern the supply of goods sold by Carsmetic Ltd (No.343246) Registered Office: - Langdon House, Langdon Road, Swansea, Waterfront, SA1 8QY ("we" and "us") to the customer ("you” and “ Your”) and constitute the entire and only agreement between us in relation thereto.

All orders placed by you are on the basis of these Terms and Conditions and are subject to acceptance by us by delivery of the goods to you at which point a legally binding contract is constituted between us. The processing of your payment and acknowledgment of your order does not constitute legal acceptance of your order.

Order Processing

Ordering and dealing with Carsmetic in all aspects of business could not be simpler, choose one of the methods listed below and leave the rest to one of the country’s leading Professional Power Tool Suppliers.

Website

The website at www.bodyshop-tools-supplies.co.uk is the quickest and most efficient way to place business with Carsmetic Ltd available to you 24 hours a day 365 days a year. When ordering goods through the website an automatically generated reply will be sent back to the customer mailbox confirming receipt of your request to order, the contract to supply is formed only when the supplier has received, reviewed and accepted your request to order. Carsmetic Ltd reserve the right to cancel any request to place any order by the customer, at any time and for any reason, with a full and complete refund being generated back through to the source account within 7 working days. Please refer further to Conditions of Website Trading & Pricing Policy for further detail regarding offshore orders and delivery.

Post and Email Orders:- Royal Mail or E Mail orders can be dealt with providing you supply the us with full and complete details of the goods required including payment in full and a daytime contact telephone number. The supplier can only accept cheques made payable in pounds sterling that can be drawn on a UK bank. Please allow seven days for cheques to clear from date of banking by Carsmetic Ltd, if the cheque and/or the amount is incorrect, the order and payment will be returned to the customer for correction before it can accepted and processed for dispatch to the customers designated delivery address.

Pricing Structures & Payment Terms

The price for any product shown on our website www.bodyshop-tools-supplies.co.uk is the price we offer you the customer the goods at, and is subject to additional carriage charges and value added tax, at the appropriate rate. Exceptions to this standard working practice may occur due to the following circumstances: every effort is made by Carsmetic Ltd to offer the best possible and correct price at all times on the website, however even with the best intentions errors may occur from time to time. Should this unfortunate situation arise at the review stage of any customer order request, the customer will be contacted at the earliest opportunity and given the choice to cancel the initial order request or proceed at the corrected price. Should Carsmetic Ltd, be unable to raise the customer to discuss this matter or receive no decision regarding price the order will be deemed to be cancelled 5 working days following date of order, with a full and complete refund being made within 7 working days of cancellation. Processing an order request through our website authorises us to debit the customers credit or debit card for the total amount of the order, full payment including carriage charges and V.A.T. at the current rate where appropriate, the total value must be received before any customer order request can be accepted and passed for shipping.

Processing Customer Orders

Handling customer orders: all orders received before 1.30 p.m. (Monday Friday, excluding bank holidays), will be dispatched same day (Subject obviously to stock availability and/or clearance of payment). Orders taken over the weekend will be despatched on the following Monday (excluding bank holidays). Carsmetic Ltd will endeavour to despatch orders for non-stock items within 5 to 7 working days of order. If there should be any delay Carsmetic will contact you with as accurate delivery as possible. Should the order be sent by Royal Mail we would ask that you allow 5 working days before calling to check the progress, due to clearance time schedules through the banking system.

Despatching & Delivery of Customer Orders

To despatch customer orders Carsmetic Ltd offer two separate methods of delivering the goods safely and effectively to the customer, using Courier Service and Royal Mail, with the option to upgrade to an AM delivery service by road. Royal Mail service is normally used for order values under £50.00, this service takes approximately 2 to 3 days to deliver using the Royal Mail Standard Parcels service; however Carsmetic cannot guarantee 100% delivery within the stated time. All other orders are despatched using 24/48hr road transport service (UK mainland only); offshore service is available including Northern Ireland at extra cost. Road transport deliveries must be signed for on delivery no shipments are left without a signature, should the delivery not be possible at your designated delivery address, a card with local contact details will be left by the courier informing you that by contacting the local depot a further delivery may be arranged at a more suitable time If you are out and we have no suitable delivery instructions the item may be returned which may incur additional cost for yourself.

The delivery charges shown are only a contribution to the cost of shipping & packing, as stated road transport delivery requires a signature for receipt of your parcel, the customer has the choice to provide Carsmetic with a private or third party business address where a stated contact should be in a position to sign for the delivery of your order. The customer should make all necessary arrangements to take delivery of any shipment from Carsmetic, as no carriage charge will be refunded should the goods remain undelivered, following all steps being taken by Carsmetic to deliver.

Warranty

All Products supplied by Carsmetic Ltd are sourced with full UK Warranties, and are normally covered by at least twelve months full manufacturers’ warranty. Please refer to the Warranty and service section.

Cancellation of an Order

As our customer you have the right to cancel any accepted order placed through Carsmetic Ltd up to 7 working days from the day after the date the goods were delivered. If you wish to cancel your order before it is despatched please notify us by e-mail on at the earliest opportunity, a full and complete refund will be issued within 7 working days. Should the goods already have left the suppliers warehouse and be in transit to the delivery address the supplier will be unable to stop the shipment, do not unpack the goods by removing the protective wrap, returning the shipment to the supplier within 7 working days using a suitable traceable method of transit at your cost. Should you already have the goods from Carsmetic Ltd and wish to return them, please re-pack the goods in a suitable protective wrap and return within 7 working days of receipt, again using a suitable method of traceable shipment at your cost. Refund to the original source for cancellation of the customer order will be for the value of the goods only, excluding carriage to and from the customer, and will only be given for machines or goods returned on the exact resalable condition as originally shipped, new and unused as originally sold, Carsmetic reserve the right to applying a 20% handling fee should you not order replacement goods. no refund will be issued for sub standard goods being returned and will be quarantined awaiting the customer uplifting his property.

Returning Goods: Damaged on Receipt, Faulty/Non Start or Incorrectly Delivered

Should any machine/equipment/product purchased from Carsmetic arrive damaged or fail to start, you must contact us within seven working days on , before returning items. Please state your order number, the name you ordered the goods under. Please follow the instructions given by one of our Technical Team, we will quickly and effectively replace (subject to availability) or refund the purchase. Goods returned to a supplier will be fully inspected to confirm the reported fault/damage originally reported, should the returned machine be found not to be faulty as originally reported, the customer may incur the cost of the return carriage charge. All goods must be returned in their original packaging where possible with care and attention being paid to adequately protecting the goods for return transit to us, failure to protect the goods for return will affect what we can do to correct the original problem, the supplier reserves the right to deduct a charge for transit damage due to a lack of care in packaging by the customer

Returning Goods Incorrectly Ordered by the Customer

On receipt of an order should you find that you have ordered the wrong item, please contact our Technical Help Line on within seven working days and clearly explain the mistake, please follow the clear instructions given to you by one of our team. Please make sure that when returning goods for exchange a traceable method of transit is used as Carsmetic cannot be held responsible or accept liability until the goods are received and signed for by Carsmetic. Replacement machines will incur a further carriage charge to despatch plus any additional adjustment in cost should the replacement differ in price from the original order, we regret that Carsmetic Ltd cannot refund any costs which the customer has incurred in returning the initial item to the suppliers warehouse. Where a refund is requested without replacement Carsmetic Ltd reserve the right to charge a restocking fee of up to 20% for any machine returned, no refunds will be given should the goods be returned and on inspection found to be in an inferior condition and not resalable. Credit payments back through to customer credit card accounts will be processed and completed within 7 working days of the goods being returned and signed for by Carsmetic Ltd.

Privacy Policy & Complaints

Carsmetic Ltd is fully committed to protecting your privacy, we only uses the information collected about the customer lawfully (in accordance with the Data Protection Act 1998). Information will only be used to process the customer order and to continue to provide a high quality service. Carsmetic Ltd will never pass information to a 3rd party. The level of service and experience in servicing the UK market allows us to be confident enough to think that the customer should be pleased with the products and services every time they are purchase, however, should the customer at anytime feel that they would like to make a complaint, or comment regarding any aspect of the service, please contact via post, email sales@carsmetic.biz, any contact regarding comments and or complaints we receive will be dealt with the urgency demanded, Carsmetic Ltd endeavour to respond to all complaints in full to the customer within five working days.

Disposal of Electrical and Electronic Equipment

The WEEE regulations (January 2007) ensure that the amount of waste on certain electrical and electronic equipment is reduced, separated from household waste, collected separately and ultimately disposed of in a sound environmental manner (recycled and recovered). If you are a trade customer, you agree that the collection, recovery/treatment and disposal of non household Electrical or Electronic Equipment purchased from us will be your responsibility. In the case of household waste, please take this waste to your nearest Designated Collection Facility (DCF) where special facilities exist for correct disposal. Conditions of Website Trading & Pricing Policy

Automatic trading on the website www.bodyshop-tools-supplies.co.uk has primarily been designed for customers with a UK mainland address. All prices shown are subject to change at any time and are shown as a guide for the suppliers warehouse stock availability only, prices cannot be held on order requests placed once initial warehouse stocks have been exhausted. All pictures and technical descriptions are for guidance only, full specifications must be double checked on the manufacturer’s websites or published literature as machine versions can change from manufacturers from time to time.

General Agreement Terms

If any part of these conditions is invalid, illegal or unenforceable (including any provision in which we exclude our liability to you) the validity, legality or enforceability of any other part of these conditions will not be affected. This contract shall be governed by and interpreted in accordance with English law.
